FINMA approves Switzerland’s first retail Bitcoin ETF
Switzerland’s Financial Market Supervisory Authority (FINMA) has approved the country’s first retail investment fund to invest directly in Bitcoin, giving individual investors a way to invest in the cryptocurrency through a regulated financial product.
The fund is classified as an ‘other fund for alternative investments’ with specific risks under Swiss law. FINMA has granted an exemption from the applicable risk diversification rules, citing Bitcoin’s long trading history and relatively high trading volume compared with other cryptocurrencies. The regulator also noted that other providers have submitted or announced applications for Bitcoin ETFs.
To strengthen investor protection, supervised institutions must address operational and custody risks, clearly explain the fund’s risks in its documentation and comply with conduct requirements under Switzerland’s Financial Services Act (FinSA). These requirements include clear risk warnings and appropriate suitability assessments when offering cryptocurrency-based financial instruments.
FINMA stressed that investing in Bitcoin remains highly risky, even through an approved fund. Bitcoin’s volatility means investors could lose a significant proportion of their capital, making the amount invested an important consideration.
Why does it matter?
A retail Bitcoin ETF offers an alternative to buying and holding Bitcoin directly, potentially attracting investors who prefer to use traditional financial products. Its introduction also raises questions about how much protection fund structures and regulatory oversight can provide when the underlying asset remains highly volatile. For regulators, the challenge is to make these investment products accessible without giving investors a misleading impression of the risks involved.
